Please read these terms and conditions carefully as it governs the relationship between us and you and limits our liability to you when you purchase products from us through this website. By placing an order you are accepting these terms and conditions and are forming a legal contract with us.
1. Order
1.1 Each order placed with us shall be an offer to buy advertised products subject to these terms and conditions.
1.2 It is the Customers responsibility to ensure that the terms of the order, including the address for delivery, are complete and accurate.
1.3 All prices stated, advertisements for products and “specials” given on this website are given on the basis that no order shall be deemed to be accepted until we have received payment in full and issued confirmation of the order and acknowledged receipt of payment in accordance with paragraph 7 below.
1.4 Any advertisements, prices stated for products and “specials” given on this website may be altered or withdrawn at any time prior to a contract for sale coming into existence.
1.5 Combardis shall endeavour to meet all orders. We do not, however, guarantee the availability of a product at any time. When a product is temporarily out of stock we will advise you of when we expect to be able to fill orders, however this shall only be an estimate and shall not be binding upon us.
1.6 Sometimes stock may be withdrawn or discontinued. We shall make every effort to update the website at all times but you understand and acknowledge that we are not liable to you for any failure or delay to accept or fill an order due to products being out of stock, withdrawn or discontinued.
2. Delivery
2.1. Delivery shall take place at the address specified in the order.
2.2. Any dates or times that we specify for delivery are intended to be estimates only and are not guaranteed. Time of delivery is not of the essence and shall not be made of the essence by notice.
2.3. Except as where stated in these terms and conditions, Combardis shall not be liable for any direct, indirect or consequential loss of whatever nature, costs, damages or expenses howsoever caused by any delay in the delivery of the products, even if caused by our own negligence.
2.4. If for any reason we are unable to deliver the products to the address stated in the order or any person at that address refuses to accept delivery of the products, all risk in the products shall pass to you and we may, at our sole discretion, charge for return of the products to us, and charge for a redelivery fee to the same or any other address nominated by you.
3. Shipping for Delivery within Australia
3.1 Shipping arrangements will be made using the Australia Post service, either standard post or express post (as selected at checkout).
3.2 Postage costs are via standard delivery without insurance. Please let us know if you would like insurance and we will manually add this cost to your invoice for subsequent payment.
4. International Shipping

5. Delivery Timeframe
5.1 Allow 7-10 business days for your order to arrive, if within Australia and up to 31 days for international customers.
6. Price and Payment
6.1. Unless otherwise agreed between you and us, the price for the products shall be the price advertised on the website at the time you place the order.
6.2. The prices stated in your order shall be inclusive of GST, and all fees and charges in relation to packaging and carriage to the delivery address (unless otherwise stated in your order).
6.3. Payment of the price of the ordered products shall be due in Australian dollars at the time of acceptance of the order.
6.4. Time for payment shall be of the essence and no payment shall be deemed received until it has been received in full and cleared funds.
7. Cancellations
7.1. Combardis does not accept any cancellations after an order has been placed and payment made.
7.2. Any enquiries in respect of Clause 8.1 shall be made in writing and sent by email to orders@combardis.com.au.
8. Refund & Returns Policy
8.1 If for any reason the products received are defective please email us at orders@combardis.com.au within 24 hours of delivery setting out why you are not satisfied with your purchase so that we can resolve any problems.
8.2 Items returned must be unused and in the same condition as received. Customer to pay return postage. Refund given will be for the cost of the item(s) not including the postage paid when sent.
8.3 This refund policy does not apply to goods which have been opened, used, damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken. All products must be returned in their original condition. All postage and insurance costs are to be paid by you.
8.4 We recommend that you return the product via Registered post and that you pre pay all postage. You assume any risk of lost, theft or damaged goods during transit; therefore advise you take out shipment registration of insurance with your postal carrier. Combardis will not be responsible for parcels lost or damaged in transit if you choose not to insure.
9. Warranties/Undertakings
9.1. All warranties, conditions and other terms implied by state or common law are, to the fullest extent permitted by law, excluded from the agreement between you and us.
9.2 In the event of a product not manufactured by us requiring replacement or repair by virtue of any warranty of the manufacturer, we shall extend the benefit of the warranty to you, and it will be for you to contact the manufacturer directly.
10. Disclaimer and limitation of liability
10.1 The information provided on this website and material provided with the products on delivery (if any) is for educational purposes only. Individuals receiving this information must exercise their independent judgment in determining its appropriateness for a particular purpose or use. Combardis shall not be responsible for any damages resulting from use of or reliance upon this information.
10.2 As the ordinary or otherwise use(s) of products is outside the control of Combardis no representation or warranty, expressed or implied, is made as to the effect(s) of such use(s), (including damage or injury), or the results obtained. Combardis expressly disclaims responsibility as to the ordinary or otherwise use(s). Customers should always refer to the ingredients label affixed to each product.
10.3 Combardis personnel are not medical practitioners and do not diagnose, treat or prescribe in any manner or form. Contact your health care provider if you suspect you have a medical condition or problem that requires treatment. All products and information offered have not been evaluated by the TGA and are not intended for medical purposes.
10.4 Nothing contained herein should be considered as a recommendation by Combardis as to the fitness for any use.
10.5 The liability of Combardis is limited to the value of the goods and does not include any consequential losses.
10.6 The products contained in this website are represented in as true a manner, as photographic processes and printing will allow. The images contained in this website are for illustrative purposes only. If you have any questions with regard to how products are packaged or labeled, please contact us.
11. General
11.1. If you breach any clause in these terms and conditions and we ignore this, we shall still be entitled to use our rights and remedies at a later date or in any other situation or under any other order where you breach these terms and conditions.
11.2. We may assign or transfer our rights and/or obligations under these terms and conditions at any time. This will not affect your rights and/or obligations under the terms and conditions. You are not permitted to transfer your rights or obligations under these terms and conditions.
11.3. If any provision of these terms and conditions is found by any court, tribunal or administrative body of competent jurisdiction, to be wholly or partially illegal, invalid, void, voidable or unenforceable it shall to that extent be deemed severed from the agreement and the remaining terms and conditions shall remain in full force and effect.
11.4. We do not intend that any provision in these terms and conditions shall be enforceable by any person that is not a party to the agreement between you and us.
11.5. All information you provide to us when placing your order shall be used in accordance with our Privacy Policy. By entering into this agreement you acknowledge that you have read and agree with our Privacy Policy.
11.6. These terms and conditions, together with the Privacy Policy and where appropriate the terms and conditions of use of the website, and any amendments to them from time to time, constitute the entire agreement between you and us.
11.7. The agreement between you and us shall be governed by the laws of New South Wales and we shall both submit to the exclusive jurisdiction of the Courts of New South Wales.
